These terms govern your use of ServerCrate services. We've written them to be readable, not just legally defensible. Six sections cover everything from acceptable use to the affiliate program.

Terms of Service

Version 1 · June 2025
Agreement

By accessing or using any ServerCrate service, you agree to be bound by these Terms of Service and all policies referenced herein. If you do not agree, do not use our services. These terms form a binding agreement between you and ServerCrate LLC ("ServerCrate," "we," "us," "our").

Account eligibility

You must be at least 18 years old and legally capable of entering into binding contracts to create a ServerCrate account. By registering, you represent that you meet these requirements.

Account security

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify us immediately at hello@servercrate.net if you suspect unauthorized access.

Service availability

We strive to maintain high availability but do not guarantee uninterrupted service. Scheduled maintenance will be communicated in advance where possible. Emergency maintenance may occur without prior notice.

Payment and billing

Services are billed on a recurring subscription basis. Fees are charged at the start of each billing period. You authorize us to charge your payment method for all applicable fees. Failure to pay may result in service suspension or termination.

Cancellation and refunds

You may cancel your subscription at any time. Cancellations take effect at the end of the current billing period. We do not issue prorated refunds for unused time unless required by applicable law. Encrypted vault data is permanently deleted within 30 days of cancellation.

Termination by ServerCrate

We may suspend or terminate your account immediately if you violate these terms, engage in illegal activity, or pose a risk to the service or other users. We will provide notice where reasonably possible except in cases of serious abuse or legal obligation.

Acceptable Use Policy

ServerCrate services are for lawful personal and business use. You agree not to use the service to:

  • Store, transmit, or distribute content that is illegal under applicable law
  • Infringe the intellectual property rights of any third party
  • Distribute malware, ransomware, or other harmful software
  • Conduct denial-of-service attacks or network abuse
  • Attempt to gain unauthorized access to our systems or other accounts
  • Resell or sublicense access to the service without prior written permission
  • Use the service in ways that degrade performance for other users
  • Circumvent any technical measures or security controls we have implemented

We reserve the right to investigate suspected violations and to take any action we deem appropriate, including suspension or termination without prior notice in serious cases.

Zero tolerance: use of ServerCrate infrastructure to facilitate illegal activity, abuse other networks, or distribute harmful content will result in immediate account termination and, where appropriate, referral to law enforcement.

Service Level Agreement

We commit to the following availability targets for production vault storage and backup ingestion services:

  • Monthly uptime target99.5% measured on a rolling 30-day calendar basis, excluding scheduled maintenance windows.
  • Scheduled maintenanceCommunicated via email or status page at least 24 hours in advance. Typically performed during low-traffic periods.
  • Incident responseWe aim to acknowledge major incidents within 1 hour and provide status updates every 2 hours until resolution.
  • SLA creditsIf monthly uptime falls below 99.5%, you may request a pro-rated service credit for the affected period. Credits are applied to your next invoice.
  • Credit exclusionsDowntime caused by your actions, third-party services outside our control, force majeure events, or scheduled maintenance windows does not qualify for SLA credits.

To request an SLA credit, email hello@servercrate.net with the subject "SLA Credit Request" within 14 days of the incident. We will review and respond within 5 business days.

Privacy Summary

This is a summary. The full privacy policy is at /privacy and is incorporated into these terms by reference.

What we collect
  • Account dataName, email, hashed password, and billing reference used to manage your account.
  • Service usage dataBackup job metadata such as snapshot timestamps and storage volume. Never file contents or filenames.
  • Transport logsIP addresses and connection timestamps. Retained 30 days, then deleted.
  • Support communicationsAnything you send us directly via email or support channels.
How we use it
  • To provision and maintain accounts and services
  • To process orders, invoices, renewals, and payments
  • To provide support and send critical service notices
  • To detect and prevent fraud, abuse, and unauthorized access
  • To comply with legal, regulatory, accounting, and tax obligations

We do not sell or rent your personal data. We may share limited information with trusted service providers, during legitimate business transfers, or when required by law.

Your rights. You may request access, correction, or deletion of your personal data by contacting privacy@servercrate.net.

Cookie Statement

What cookies are. Cookies are small text files stored on your device by websites you visit. They help the site function, maintain login state, and provide aggregate operational insights.

How we use cookies. ServerCrate uses cookies and similar technologies for site functionality, user preferences, analytics, and affiliate referral tracking. We do not use third-party advertising cookies for behavioral ad targeting.

Your choices. You may manage non-essential cookies through your browser settings. Disabling certain cookies may impact some parts of site functionality.

Third-party cookies. Some cookies may be set by third-party services we use, such as analytics providers. Their behavior is governed by their own policies, not ours.

Do Not Track. Our site does not currently guarantee response to all browser "Do Not Track" signals. If you want stricter blocking, use browser-level privacy tools such as uBlock Origin.

Legal

Account management and security. You must be at least 18 years old to create a ServerCrate account. Keep your information accurate and current. If you suspect account compromise, contact hello@servercrate.net immediately.

Copyright infringement and DMCA. If you believe content hosted through ServerCrate infringes your rights, send a valid DMCA notice to hello@servercrate.net. Customers may submit a counter-notice where appropriate.

Third-party services and software. Some services may integrate with third-party providers, panels, payment systems, or software. Those services remain subject to their own terms and limitations.

Disclaimer of warranties. Services are provided on an "as is" and "as available" basis unless a specific written agreement says otherwise. We do not guarantee uninterrupted, error-free, or vulnerability-free operation.

Limitation of liability. To the maximum extent permitted by law, ServerCrate is not liable for indirect, incidental, special, punitive, or consequential damages. Our aggregate liability is limited to the amount of fees you paid for the affected service in the 12 months before the claim.

Indemnification. You agree to defend, indemnify, and hold harmless ServerCrate from claims, liabilities, damages, costs, and expenses arising from your misuse of the services, your hosted content, or your breach of these terms or applicable law.

Governing law and venue. These terms are governed by the laws of California, USA. Disputes are subject to the exclusive jurisdiction of the courts in Los Angeles County, California, except where law requires otherwise.

Class action waiver. To the extent permitted by law, claims must be brought individually and not as part of a class, consolidated, or representative action.

Network fair use. ServerCrate may offer high-throughput connectivity. These are provided on a fair-use basis. Sustained traffic patterns that materially degrade shared infrastructure, resemble flooding, or threaten network stability may be rate-limited or filtered at our discretion.

Modification of terms. We may update these terms from time to time. Continued use of the service after updated terms take effect constitutes acceptance of those terms.

Short version: if your use of the platform creates legal, operational, or abuse risk for ServerCrate, we reserve the right to act first and argue later.

Affiliate Program

Version 1 · June 2025

Enrollment and eligibility. To become an affiliate, you must register through the affiliate signup process, be at least 18 years old, and receive approval from ServerCrate. Approval is not guaranteed. Once approved, you will receive a referral link and access to permitted brand assets.

Commission structure and payment. ServerCrate may offer recurring commissions for valid referred customers who remain active and in good standing. Commissions are paid according to the active affiliate program terms, subject to payout thresholds, refund reversals, fraud review, and tax compliance.

Affiliate obligations. All promotional activity must be truthful, lawful, and clearly disclosed where required by law. Spam, misleading claims, impersonation, fake discounts, fake reviews, trademark abuse, and brand misrepresentation are prohibited.

Fraud and self-referrals. Self-referrals, fake accounts, forced-cookie tactics, fraudulent conversions, deceptive ads, or any attempt to manipulate attribution are grounds for immediate termination and forfeiture of unpaid commissions.

Program administration. We may review affiliate traffic quality, referral behavior, and promotional methods at any time. We reserve the right to reject referrals, withhold commissions during investigation, or remove an affiliate from the program.

Termination. Either party may terminate the affiliate relationship at any time. If termination is for fraud, abuse, or breach, unpaid commissions may be voided. If termination is not for cause, eligible outstanding commissions may be paid under the current payout rules.

Relationship. Affiliates are independent contractors and are not employees, agents, or representatives of ServerCrate.
