The legal foundation of your use of ServerCrate’s services. Please read carefully before using or continuing with any hosting product.
Lawful Purposes Only: You may only use ServerCrate services for lawful purposes. You agree not to use our servers for any illegal activities, including (but not limited to) distributing malware or viruses, engaging in phishing scams, launching attacks, or hosting copyrighted material without proper authorization. Users are solely responsible for all content they upload or host and for ensuring that content is legal in the United States and any jurisdiction where you operate.
No Spam or Network Abuse: Mass unsolicited emailing (“spam”) or network abuse from our servers is strictly prohibited. This includes sending bulk emails in violation of the CAN-SPAM Act and any activities that could harm or blacklist our network. You must comply with all applicable email and marketing laws when using our services for communications.
Resource and Security Restrictions: You must not use excessive server resources in a way that disrupts service for others. Prohibited actions include deliberate CPU, IO, or network overload, unauthorized crypto-mining, or attempts to bypass security measures. You also agree not to use our services to gain unauthorized access to any system or perform activities like port scanning, denial-of-service attacks, or distributing hacking tools.
No Harmful or Offensive Content: Hosting content that is fraudulent, defamatory, harassing, or promotes violence or illegal activities is forbidden. Absolutely prohibited is any content exploiting or harming minors or content that violates others’ rights. ServerCrate will report suspected child exploitation or other criminal content to law enforcement as required by law.
Account Security: You are responsible for maintaining the confidentiality of your account credentials. Do not share account access with unauthorized persons. Notify us promptly if you suspect unauthorized use or a security breach. To change your account’s primary email address, submit a support ticket and verify your identity. You are liable for all actions taken using your credentials.
Monitoring and Enforcement: ServerCrate actively monitors server performance, network traffic, and logs to maintain stability, security, and compliance. Monitoring data is handled confidentially and used only to improve our services, assist with support, and enforce our policies. We respect user privacy while protecting our infrastructure.
Violation Consequences: If we detect a violation of these policies or misuse of our services, we reserve the right to take immediate action, including warning you, removing or disabling access to offending content, or suspending/terminating your services without prior notice. Severe violations may result in immediate termination and data removal without liability.
Abuse Reporting: We have a zero-tolerance approach to abuse. If you become aware of misuse of ServerCrate services, please report it to abuse@servercrate.net. We will investigate all abuse reports and take appropriate action, including cooperating with law enforcement as needed.
Legal Compliance: You agree to comply with all applicable laws and regulations, including U.S. export control and sanctions laws. We may suspend or terminate services if we believe you or your content are subjecting us to legal risk or violating law. Where practicable, we will notify you of the action taken and the reason, unless prohibited by law or security concerns.
Data Backup and Maintenance: You are responsible for maintaining backups of your content and data stored on our servers. While ServerCrate may perform routine backups for disaster recovery, we do not guarantee the availability, integrity, or restorability of your specific data. We strongly encourage you to implement your own backup solutions. ServerCrate is not liable for data loss or corruption except as expressly required by law.
Service Level Agreement (SLA): ServerCrate Service Level Agreement (SLA) – Last updated: August 2025. This Service Level Agreement (“SLA”) is part of the Terms of Service between ServerCrate LLC (“ServerCrate,” “we,” “us”) and the customer (“you,” “client”). It outlines the uptime guarantees, support commitments, and compensation terms for covered services. ServerCrate operates infrastructure in Los Angeles, California with enterprise-grade hardware, NVMe storage, and Path.net DDoS protection. We do not oversell resources — your allocation is reserved. Server Uptime Guarantee: ServerCrate guarantees 99.9% monthly uptime for all VPS and Game Hosting services, including network connectivity, power, and infrastructure. This guarantee excludes scheduled maintenance (announced at least 24 hours in advance), emergency maintenance required to maintain security or stability, downtime caused by customer misconfiguration, software or third-party failures, DDoS attacks originating from your server, or force majeure events such as natural disasters or upstream carrier outages. Support Response Times: Critical issues such as outages or no connectivity will receive an initial response within 1 hour. High-priority issues such as degraded performance or partial outages will receive an initial response within 4 hours. Normal support tickets such as setup, configuration, or billing will receive an initial response within 12 hours. Support is available 24/7/365 via the ServerCrate Client Area. Service Credits: If uptime falls below the guaranteed level in a given month, customers may request service credits. Uptime of 99.0%–99.89% qualifies for a 5% credit of the monthly fee. Uptime of 95.0%–98.99% qualifies for a 10% credit of the monthly fee. Uptime below 95.0% qualifies for a 25% credit of the monthly fee. Credits must be requested via support ticket within 7 days of the outage, are applied to future invoices only, and are the sole remedy for downtime claims under this SLA. DDoS Protection: All services include Path.net enterprise-grade DDoS mitigation. SLA uptime guarantees apply to the network after traffic reaches Path.net. Attacks exceeding the maximum mitigation capacity or originating from within your server (e.g., outbound floods) are not covered under this SLA. Hardware Replacement Guarantee: In the event of dedicated hardware failure, including drives, memory, or CPUs, ServerCrate guarantees replacement within 4 hours of identification. VPS and game server nodes use enterprise-grade NVMe storage and ECC memory to minimize failure risk. Limitations: This SLA is not a warranty. It does not cover indirect, incidental, or consequential damages. Maximum liability is limited to the value of service credits as defined above. Claiming SLA Credit: To claim credit, you must open a support ticket within 7 days of the outage including the date and time of the outage, the affected service(s), and any relevant logs or evidence. ServerCrate staff will review and, if validated, issue the applicable credit. ServerCrate was built to be faster, tougher, and more reliable than budget hosts. This SLA is our written commitment to that standard.
ServerCrate respects your privacy and is committed to handling personal information in compliance with applicable laws including the CCPA and GDPR. This Privacy Policy explains what data we collect, how we use it, how we protect it, and your rights regarding your information.
Account and Contact Information: When you register or interact with our services, we collect information such as your name, email address, billing address, telephone number, payment details, and account credentials (stored securely).
Service Usage Data: We collect data about how you use our hosting services, including server logs (IP addresses, login timestamps, resource utilization), domain and website information, and support ticket history. This helps us monitor performance, ensure security, and improve your experience.
Support and Communications: If you contact us for support, we collect the information you provide (such as issue descriptions or screenshots). Calls or chats may be recorded for quality assurance.
Cookies and Tracking: We use cookies and similar technologies to enhance your experience, analyze site traffic, and personalize content. See our Cookie Statement for details.
Service Provision: To set up and maintain your account, process orders and payments, and provide the hosting services you request.
Account Support and Communication: To provide customer support, troubleshoot issues, and send critical account notices (e.g., security alerts, maintenance notifications, billing reminders).
Improvement and Analytics: To understand how our customers use our services and to improve performance and reliability.
Security and Abuse Prevention: To monitor, detect, and prevent fraudulent, harmful, or unauthorized activity, and to enforce our Acceptable Use Policy.
Legal Compliance: To comply with legal obligations, respond to lawful requests, and maintain records for financial and tax regulations.
Marketing (Opt-In): With your consent, we may send you newsletters or promotions. You can opt out at any time.
We do not sell or rent your personal data to third parties. We may share information with trusted service providers, in business transfers, to comply with legal requirements, or within our corporate family, always with appropriate safeguards.
Your data may be transferred to, stored in, and processed in the United States or other jurisdictions. We take steps to ensure your data is protected in line with this policy wherever it is processed.
We employ industry-standard security measures, including encryption, access controls, and regular security testing. No method is 100% secure, so we encourage you to use strong passwords and enable two-factor authentication.
We retain personal data as long as necessary for the purposes outlined, or as required by law. We aim to delete or anonymize data when it is no longer needed.
You can access and update your account information via the client portal. You may request access, correction, or deletion of your data by contacting privacy@servercrate.net or support@servercrate.net. We will verify your identity before fulfilling requests.
California Residents: You have specific rights under the CCPA/CPRA. We do not sell your personal information. To exercise your rights, contact us at privacy@servercrate.net.
EEA/UK/Swiss Residents: You have rights under the GDPR. Contact us at privacy@servercrate.net to exercise your rights or lodge a complaint with your data protection authority.
Our services are not directed to children under 13. We do not knowingly collect data from children under 13. If you believe a minor has provided us with information, contact us for prompt deletion.

Third-Party Services and Software: ServerCrate services may integrate with third-party services or software, which are subject to their own terms. We are not responsible for third-party services or content.
Disclaimer of Warranties: All services are provided “as is” and “as available,” without warranties of any kind. We do not guarantee continuous, error-free, or virus-free operation. You assume all risk associated with use of our services.
Limitation of Liability: ServerCrate is not liable for indirect, incidental, or consequential damages. Our total liability is limited to the amount of fees you paid us for the relevant service in the 12 months preceding the claim.
Indemnification: You agree to indemnify and hold harmless ServerCrate from any claims arising out of your misuse of the services, your content, or your violation of these terms or laws.
Governing Law and Dispute Resolution: These terms are governed by the laws of California, USA. Disputes are subject to the exclusive jurisdiction of the courts in Los Angeles County, California. Class actions are waived to the extent permitted by law.
Modifications to Terms: We may update these terms from time to time. Continued use of our services after updates constitutes acceptance of the new terms.
Network Fair Use: ServerCrate provides high-speed connectivity options including 1 Gbps and 10 Gbps ports. These connections are offered on a fair-use basis. Sustained usage that negatively impacts network stability, degrades performance for other customers, or resembles abusive patterns (such as constant maxed-out throughput, bandwidth flooding, or excessive simultaneous connections) may be subject to temporary throttling or port speed adjustments at our discretion. Normal gaming, hosting, and business workloads are not affected. This policy ensures all customers receive reliable and consistent performance.
Miscellaneous: These terms constitute the entire agreement between you and ServerCrate. If any provision is held invalid, the remaining provisions remain in effect. Questions? Contact legal@servercrate.net.
Enrollment and Eligibility: To become an affiliate, register through our program sign-up page. Affiliates must be 18 years or older. Once approved, you will receive a unique referral link and access to marketing materials. Use of our brand is only permitted as instructed.
Commission Structure and Payment: Our program offers recurring commissions for each customer you refer who remains active. Commissions are paid monthly, provided you meet the minimum payout threshold. Taxes are your responsibility.
Affiliate Obligations and Code of Conduct: All marketing must be truthful and comply with laws. Spam, misleading claims, and impersonation are strictly prohibited. Disclose your affiliate relationship as required by law.
Program Administration and Compliance: We monitor affiliate activity for compliance and fraud. Self-referrals and fraudulent activity are grounds for termination and forfeiture of commissions. Keep your account information up to date.
Term and Termination: Either party may terminate the affiliate relationship at any time. If terminated for breach or fraud, unpaid commissions are forfeited. Otherwise, eligible commissions will be paid out.
Liability Limitations: ServerCrate is not liable for indirect damages. Our total liability is limited to commissions paid in the past three months. We do not guarantee uninterrupted tracking or earnings.
Independent Contractor Relationship: Affiliates are independent contractors, not employees or agents of ServerCrate.
